The Blackpool and Fleetwood Tramway ("Tramway") runs for approximately 18km from Starr Gate (located to the south of Blackpool) to Fleetwood (located to the North of Blackpool). Much of the tramway infrastructure dated from the 1930s and the Contracting Authorities are in the process of refurbishing the existing infrastructure and vehicles. The Tramway is currently operated by Blackpool Transport Services Limited ("BTS"), a subsidiary of Blackpool Borough Council, pursuant to a series of lease arrangements. For the purposes of Article 5(2) of the European Regulation on Public Passenger Transport Services by Rail and Road (1370/2007) ("Regulation"), BTS is a legally distinct entity from the Contracting Authorities over which at least one of the Contracting Authorities exercises control similar to that exercised over its own departments. The Contracting Authorities intend to terminate the existing lease pursuant to which BTS operates the tramway. The Contracting Authorities will then, in accordance with Article 5(2) of the Regulation, directly award to BTS a more detailed 15 year operating concession setting out the terms (including stricter service standards relating to frequency, capacity, comfort and quality) pursuant to which BTS will continue to operate and maintain the Tramway (which may include any future extensions thereto which are implemented during the term of the concession). In accordance with the requirements of the Regulation, the Contracting Authorities published a Prior Information Notice on 8 April 2010 to give notice of their intention to enter into the new operating concession with BTS (reference 2010/S 68-101984).
