The Nursery Milk Scheme is governed by legislation enabling powers are in the Social Security Act 1988. Under the Welfare Food Scheme Regulations 1996, the Department of Health (DH) operate a free nursery milk scheme for all children under the age of five in attendance of a day care or early years setting (location/sites) for two or more hours per day. Each child is eligible to receive a free daily drink of milk (1/3 pint or 189 ml). Children less than one year old are given infant formula. Reimbursements and claims are currently governed under this Act. Introduction and background Under the Deregulation and Contracting Out Act 1994, Health Ministers are permitted to authorise a contractor(s) to provide services, such as a direct delivery partner(s) appointed by DH. The DH is seeking to appoint direct delivery partners for the provision of services for the modernised nursery milk scheme to day care or early year settings in Great Britain. The consultation exercise was held in 2012 and the DH consulted on four options, 1) Do Nothing, 2) Cap the Price, 3) Issue E Vouchers and 4) Direct Delivery to Settings. The consultation shows that the majority of respondents are in support of receiving milk as a direct delivery. DH will continue to fund free milk but the scheme will be no longer allow for the reimbursement of milk. The new provision is to operate a direct supply contract. The objective of this tender is to modify and simplify the scheme which has remained largely unchanged since the 1940's. A direct delivery contract with fixed pricing will improve the cost effectiveness of the scheme and the contractor(s) must provide a clear proposal on how they intend to achieve value for money whilst placing the lowest burden on child care settings. SCOPE OF PLANNED PROCUREMENT The key outcomes for the modernisation of Nursery Milk scheme is to maintain and improve satisfaction levels of nursery settings eligible for free milk. The Department also seeks to improve value for money, support the inclusion of SME within the supply chain as per the Government policy, inclusion of public sector equality duty and provide a sustainable price paid to farmers, while ensuring that all eligible children continue to receive free nursery milk. The new contract will replace the Nursery Reimbursement Unit in full and claims will no longer be reimbursed, with the exception of residual claims. The appointed contractor (s) will have the sole responsibility of managing the scheme and duties include administration, registration and distribution for circa 55,000 locations throughout Great Britain. The anticipated budget is projected at between £25 million and £35 million pounds per annum. The new contract will ensure that all children under five in a day care or early years setting for two or more hours a day are eligible to receive a daily drink of milk (1/3pint). Children under the age of one, receive infant formula. The current nursery milk scheme reimburses childcare providers for the full cost of milk and currently funds free milk for around 1.5 million children under 5 years old in 55,000 childcare settings in Great Britain or a greater number as demand for the scheme increases. Childcare settings include child-minders and crèches, as well as private and local authority run nurseries, and primary schools reception classes across Great Britain. More details will be provided in the draft ITT documents that will be circulated to those who register, before the event. The Department has not at present decided the overall approach to the proposed Procurement including the lots strategy or if lots will apply. Contract period/duration The period of contract will be for 3 Years with option to extend for year 4 and year 5. This will be from 01/01/2015 to 31/12/2017 and the Authority may extend the Contract by up to further period(s) up to 24 months in total, by issuing a contract variation(s) no later than one Month before the Contract would otherwise expire. This will be subject to satisfactory performance, availability of budget and both internal and external approvals as necessary. Thus, there will be a 12 month break clause in case of performance or breach of contract issues.12 month break clause may be invoked for a failure to utilise SMEs as promised within any bid.
