Invitation to participate in a technical dialogue in connection with a call for tenders regarding marine pollution control in Danish waters.

In accordance with the Danish Defence Agreement 2013-2017 of 30 November 2012 (the Defence Agreement), tenders will be invited regarding, inter alia, the ship-based part of the task of fighting marine pollution. The call for tenders is to determine whether the Danish Defence should advantageously outsource this task or whether it should remain under the auspices of the Danish Defence. The result of the call for tenders will thus be compared with a calculation made by the Danish Defence. The tender procedure must be completed by June 2015 in order to allow a decision at this time of whether to outsource the task. The practical solution of the task is expected to consist of the maintenance of a vessel/personnel preparedness to be used in the event of pollution for, typically, an initial containment to control damage and a subsequent recovery of the pollutant. The Defence Command Denmark intends to carry out a technical dialogue with operators in the market prior to publication of a contract notice regarding the ship-based marine pollution control in Danish waters. The dialogue is to give the Defence Command Denmark a greater knowledge of the market of ship-based marine pollution control - including the possibilities of procuring and financing the necessary vessels - in order to be able to draft specific and useful tender material. With this prior information notice, interested operators are invited to participate in the technical dialogue. General information about the call for tenders: The ship-based marine pollution control is at present handled by the four pollution-combating vessels of the Danish Navy (two vessels of the Sea Truck class and two of the Supply class) and the call for tenders covers the tasks/functions attached to these four vessels. The four pollution-combating vessels are more than 30 years old and have come to the end of their useful lives. Therefore, the vessels are not presently included in the plans for the future marine pollution efforts. Hence, the procurement of replacement vessels is necessary. This applies irrespective of whether the task will henceforth be solved under the auspices of the Danish Defence or by an external supplier. The Defence Command Denmark is presently seeking to find the most suitable framework for the solution of the task to be put out to tender, including the related requirement for procurement, operation and maintenance of replacement vessels. To this end, the Defence Command Denmark intends to hold a technical dialogue with operators in the market with a view to achieving relevant knowledge. The preliminary overall framework of the forthcoming tender is as follows: — A private supplier is to provide its own vessels and personnel, — In the future preparedness, the current area covered is expected to be extended, i.e. an extension of the part of the Danish waters which the current four pollution-combating vessels located in Frederikshavn and Korsør, respectively, are able to reach in 8 hours, — Pollution control must be possible in dangerous environments with toxic gas and low flash point, — The Admiral Danish Fleet (Søværnets Operative Kommando (SOK)) will remain in command during the specific solution of a task. A decision has not yet been made with respect to flag state requirements. In addition to the pollution-combating vessels, the Danish marine pollution control preparedness includes a number of other vessels as well, among them the maritime surveillance vessels of the Danish Navy and the vessels of the Naval Home Guard. These vessels will not be included in the call for tenders and, therefore, will be able to assist, as at present, in specific situations, including the initial containment of the pollutant to control damage. The technical dialogue - application, selection and execution: As stated above, the Defence Command Denmark aims to be able to prepare specific and useful tender material which is in conformity with the general expectations and possibilities of the market. It has therefore been decided to carry out a technical dialogue with the market in accordance with recital 8 of the preamble of the public sector directive: “Before launching a procedure for the award of a contract, contracting authorities may, using a technical dialogue, seek or accept advice which may be used in the preparation of the specifications provided, however, that such advice does not have the effect of precluding competition.” The technical dialogue will be carried out as individual meetings with each of the participants of the dialogue. The meetings are expected to last 2-3 hours and will be held at the end of August/beginning of September 2014 in central Copenhagen. The Defence Command Denmark has not finally decided the issues to be discussed in the dialogue. At present, a discussion of the market's view of the following issues is expected: — Tender strategy, including the composition of the market (operators and market shares), — Cooperation structure (public-private partnerships, command, exercise of authority, etc.), — Technical solutions in the market (the characteristics of various vessel capacities), — Public law requirements and conditions (environmental approval, vessel approval, flag state, etc.), — Requirements and model of financing the vessels and other equipment (for example public-private partnership and public-private cooperation). Prior to the meetings, a question frame will be submitted with specific questions to be answered at the meeting. The question frame will be published at the website www.forsvaret.dk and is found by clicking “Udbud (Tender)” under the tab “Genveje (Shortcuts)" and then by going to the tender page of the Defence Command Denmark. Additional questions may be raised after submission of the question frame. Such additional questions will be published in the same way. In addition to publication at the website of the Defence Command Denmark, all operators having applied for participation in the technical dialogue (not only the participants finally invited) will receive the question frame as well as the additional questions by e-mail (if an e-mail address has been informed). Operators not participating in the dialogue meetings are welcome to submit input and comments to the published question frame. The meetings will be organised so that all participants will receive the same information. If information is provided which does not appear from the written material prepared, such information will subsequently be published at the above website, so that operators unable to participate in the dialogue meetings will be ensured access to the same information. Participation in the technical dialogue is thus not a precondition for participating in the expected tender procedure and will provide no better position for the prequalification or tender stages. It is emphasised in this connection that the meetings are not a service to market operators to become better prepared for a forthcoming tender, if any. They merely serve as an opportunity for the Defence Command Denmark to gain knowledge of the market through an open, professional and objective dialogue with a group of operators representative of the market. After the dialogue meetings, the Defence Command Denmark will draw up a brief summary and post it on the website of the Defence Command Denmark at www.forsvaret.dk. The dialogue meetings will not necessarily be the end of the technical dialogue, in that the Defence Command Denmark may choose to follow up in writing. The Defence Command Denmark is free to choose if - and in the affirmative to which extent - conclusions from the meetings will be included in the subsequent decision-making process and the preparation of the final tender material. The dialogue will be carried out with a limited number of participants, i.e. in the range of 5-10 potential suppliers/subcontractors. If the Defence Command Denmark receives applications from a larger amount of operators, the selection of the participants will be based on objective and substantive criteria, since it is the aim of the Defence Command Denmark to compose a group of dialogue participants which is representative of the market in relation to: — Different methods of fighting pollution, including strategy, tactics, equipment, personnel, etc. — The main types of services expected to be included in the tender, including knowledge of: — financing, — building of vessels and other pollution control equipment, — operation and maintenance, — technical maritime pollution control. In addition, the participants' general experience of similar projects will be weighted positively. Application for participation in the technical dialogue is to be sent to specialist consultant Susanne Taarnehøj at fko-osu107@mil.dk no later than 26.6.2014 at 14:00 h. In the subject field the following should be stated: “Marine environment: Application for participation in technical dialogue”. The application must include a brief description of the operator's business in relation to the matters stated above to be used for the selection of participants in the dialogue. This description must be in Danish or English. The Defence Command Denmark reserves the right to request that the participants submit relevant business details for the selection, if any, of the participants for the dialogue meeting. Information about participation in the dialogue meeting, including time and place, is expected to be submitted approx. one week after the expiry of the deadline for application, i.e. in the beginning of July 2014. No fees or compensation for participation in the technical dialogue will be given, including preparation of material, travel expenses, etc.
