The requirement for the BBC to provide Access Services is outlined in the Communications Act of 2003 and is regulated by Ofcom. Access Services include subtitling, audio description and signing. Delivery of Access Services includes commissioning, authoring, production, aggregation for playout and distribution to broadcast and on demand platforms. The section of this process that includes commissioning, authoring and production of AS content is the subject of this procurement. The BBC is conducting a competitive procurement for the provision of Access Services. The BBC considers the subject matter of the procurement to fall wholly within the scope of Regulation 6(2)(f) of the Public Contracts Regulations 2006 (the “broadcasting exemption”). In the alternative the subject matter falls in any event within Part B of Schedule 3 to those Regulations. However, in order to maximise the transparency, competitiveness and effectiveness of the process the BBC proposes to conduct the procurement on a voluntary basis, using as a framework and guide the competitive dialogue procedure under the Regulations. This is a three stage procedure comprising of the Pre-Qualification Questionnaire (“PQQ”) used to longlist potential providers, dialogue and the Invitation to Tender (“ITT” used to evaluate tenders submitted by the shortlist of potential providers). (For an overview of the competitive dialogue procedure the BBC intends to follow see Section D below.) Any reference in the PQQ or the PQQ Information Pack to the Regulations or any provision thereof is used only for the purpose of explaining or giving context to the BBC’s requirement, eligibility conditions or standards in this voluntary procedure. Important: The Contract(s) will have a term of up to 10 years commencing on 1st January 2014. The actual length of contract(s) awarded will be decided during the course of the competitive dialogue process having regard to the information made available to the BBC by participants. Please note, the contract values stated in Sections II.2.1 and II.1.8 are estimated ANNUAL values.
