I. Information for publication in the Official Journal of the European Union (1) 1. Name and address of the contracting entity. Nature of the contract (supplies, works or services and Nomenclature reference No(s); where appropriate state if it is a framework agreement). Design, build, operate and maintenance (DBOM) contract for the Tafila Wind Farm located in Jordan, Tafila Governorate, Southeast of the town of Gharandil (Postal Code 66645) under EIB financing. 3. At least a summary indication of the nature and quantity of the products, works or services provided. The works that will be contracted under a DBOM contract is to cover the design, supply, installation, commissioning, putting into service and the maintenance of the Tafila wind farm to enable approximately 117 MW to be exported to the national Jordanian transmission system of NEPCO, including the civil works, substation, HV connection infrastructure, fibre optic cable networks and other ancillary works. 4. (a) Form of the call for competition (notice on the existence of a system of qualification; periodic notice; call for tenders); Negotiated tender procedure without a call for competition following a prior closed and unsuccessful restricted tender process. The following steps were carried out during this tender process: - pre-qualification stage during April and May 2012; - Original tender procedure: restricted tender process until October 2012, resulting in the receipt of only one bid from Vestas Italia S.r.l. that was substantially responsive from a technical perspective but not totally responsive from a commercial point of view. Gamesa Eólica S.A. submitted a bid that was not eligible according to the tender evaluation process. Therefore, the restricted tender procedure was deemed unsuccessful; - Following the unsuccessful restricted tender process, a negotiated procedure without a call for competition as final tender procedure was chosen - Invitation to a negotiated procedure without a call for competition for the provision of a full DBOM contact based on the FIDIC Gold DBOM structure (starting with Vestas) in October 2012, due to unsatisfactory receipt of replies from the other invited bidders; - Negotiated tender procedure without a call for competition until April 2013; - On April 24th 2013, JWPC declared that an agreement in principle on the DBOM had been achieved with Vestas Italia S.r.l. and it therefore decided to award the DBOM Contract to Vestas Italia S.r.l, subject to final contract; - A 7 day period was granted to the bidders to raise complaints or objections following JWPC’s declaration, during which period JWPC did not receive any queries or complaints; - Agreement on final contract with Vestas Italia Via Tirso 14, 00198 Rome, Italy on June 7th 2013 (apart from a few minor issues that are not considered substantial and were finalised prior to the signing of the DBOM contract).
