In the event of a cancellation, FLO is obliged to provide written notification with a short justification, cf. FOA § 20-16(2) letter b. The question of whether there is a "justifiable reason" for the cancellation shall be decided after a total evaluation, in which the date and purpose of the cancellation are considered, amongst other things. In the tender documents FLO had a number of obligatory requirements for the performance, cf. annex G in part 1 - Technical specifications. One such requirement was that the gyrocompass should be fibre optical, cf. point 3.2.1.2 “Technology“. FLO received a question from a tenderer on whether FLO would accept tenders for a compass of the type “Hemispherical Resonator Gyro (HRG)“. FLO realised that the requirement on the gyrocompass being fibre optical meant that the suppliers who fulfilled all the other obligatory requirements, but who could only deliver gyrocompasses with another technology would be excluded from participating in the competition. FLO would therefore like to change the requirement from an obligatory minimum requirement to an evaluation criterium. The change will allow for a better competition. FLO emphasises that the period between the tender notice and the cancellation is short. As the actual change to the tender documents will be significant, cf. FOA § 17-2(1), FLO deems to necessary to cancel the competition and reannounce the competition with the relevant change. FLO encourages interested tenderers to submit a tender in line with the new notice.
