Detection apparatus for mines. The Manoeuvre Support Team (MST), part of Land Equipment (LE) of the UK Ministry of Defence (the “MOD”), proposes to let a 1 year contract (with options for a further 2 years) with Pearson Engineering Limited (the „Contractor”) for the In-Service Support requirement in support of the Super Light Weight Roller (SLWR) pursuant to Article 28(1)(e) of Directive 2008/81/EC (Regulation 16(1)(a)(ii) (exclusive rights) of the Defence and Security Public Contracts Regulations 2011) (the “Regulations”). The SLWR System used for route clearance, which is attached to a host vehicle, in this instance HUSKY Protected Vehicle, and MST has previously placed a contract with the Contractor for 69 Systems and associated support under this UOR. In order to ensure that this capability can be supported until the withdrawal of UK ground forces from Afghanistan by 31 December 2014, MST intends to award a sole source contract to the Contractor to cover the enduring support solution for a period of 1 year with options for a further 2 years. The initial cost of this contract will be approximately £880,000, with an estimated final total contract being valued at approximately £2,000,000. It is considered that this contract can be placed using the Negotiated Procedure Without Prior Publication under Regulation 16(1)(a)(ii) of the Regulations on the basis that the Contractor has exclusive rights for the SLWR System, underpinned by Patent Application Number EP12171388.7 dated 08 June 2012. The Contractor also has Unregistered Design Rights in the individual proprietary parts of the system. The MOD holds user rights for this equipment but does not have a licence for manufacture of modification of the equipment to use the exclusive rights which would enable it to seek competitive bids, and no third party, including the MOD, has been granted a licence to use these exclusive rights. Further, there is no available lawful equivalent that another supplier could offer to satisfy this requirement.
