Læses: II.1.4) Short description of the contract or purchase(s): This Notice is a Modification to a Contract in accordance with Article 72 of Directive 2014/24/EU and Regulation 72 of the Public Contracts Regulations 2015. Following a procurement (contract notice reference 2013/S 041-065497 of 27.02.2013) the Council engaged in February 2014 CA Blackwell to undertake works to construct a strategic flood storage solution at Weston Super Mare (contract award notice reference 2014/S 073-125192 of 12.4.2014 ‘Construction of strategic flood storage at Weston-Super-Mare’). The Council determined that this flood storage solution was required in order to facilitate the planned growth of 6 000 new homes, associated schools, community facilities and the development of 40 hectares of employment land adjacent to Weston Super Mare. The works were let as a single contract with 2 distinct phases. Phase 1 (construction of a superpond) has been completed. Phase 2 involves the creation of a compound channel adjacent to the River Banwell. The contract has been modified in relation to the means of execution of the Phase 2 works. The original scope of Phase 2 envisaged the distribution of excavated material over 3 fields adjacent to the site. Due to planning requirements the excavated land will now be spread more thinly over a wider area (approximately 35 hectares instead of approximately 14 hectares) with a corresponding increase in the contract value to reflect the alteration to the means of execution of the works. The modification to the Contract was entered into on 6.7.2015 and the contract end date has been agreed as 31.3.2016. Yderligere supplerende oplysninger The Council determined that a flood storage solution was required in order to facilitate the planned growth of 6 000 new homes, associated schools, community facilities and the development of 40 hectares of employment land adjacent to Weston Super Mare. The works were let as a single contract with 2 distinct phases. Phase 1 (construction of a superpond) has been completed. Phase 2 involves the creation of a compound channel adjacent to the River Banwell. Whilst section V.1 of this notice refers to a Contract Award Decision, the Council has not in fact awarded a new contract but has made a non-material amendment to an existing one. The contract price (both pre- and post-modification) is set out below. The original scope of Phase 2 involved lowering the existing ground levels over an area of approximately 14 hectares and stock piling excavated material across three fields immediately adjacent to the area of excavation. A planning requirement to deal with the excavated material on site has required a change to the area across which the excavated material is to be distributed. The excavation volume will be maintained but the material will now be spread over across 35 hectares rather than approximately 14 hectares as initially envisaged. Minor consequential modifications provide for installation of a new access bridge, minor bank raising works, the installation of a handrail on an existing access bridge, and the provision of fencing and gates in the area covered by the Phase 2 works. The modifications to the contract became necessary due to planning requirements as to the distribution of excavated material. A change of contractor could not have been made for economic reasons, would have caused substantial inconvenience to the Council, and the corresponding increase in the price of the contract does not exceed 50 % of the original contract value (the modification therefore falls within the scope of Regulation 72(1)(b) of the Public Contracts Regulations 2015 and a new advertisement was not required). Further, the modification is not substantial (Regulation 72(1)(e)). The modification does not render the contract (or its scope) materially different to the one initially concluded; the Council does not consider that the modification would have allowed for admission of other candidates or tenders, or attracted other participants, and does not change the economic balance in favour of the contractor. Delay to completion of Phase 2 of the contract would have increased the risk of flooding and would have significantly delayed the development and infrastructure works that are dependent on prompt completion of the strategic flood prevention works. Those development and infrastructure works are a key component of the Council's strategic plan for the area, and delay would have caused substantial inconvenience to the Council, acting on behalf of the residents of Weston Super Mare. Delay in Phase 2 would further delay a New Homes Payment of between 4 600 000 GBP and 5 000 000 GBP which is a key element of the Council's medium term financial plan. The modification to the contract was entered into on 6.7.2015 and the completion date has been agreed as 31.3.2016. The contract value before the modification was 3 475 286,60 GBP excluding VAT The contract value after the modification is 4 454 139,68 GBP excluding VAT The increase in price as a result of the modification is 978 853,08 GBP excluding VAT The contractor is CA Blackwell whose contact details are set out in section V.3. CA Blackwell is not an SME. The contract has not been awarded to a group of economic operators.
