With reference to the tender documentation point: — “6.1 Cancellation of the competition and total rejection, — the contracting authority can cancel the competition or discard all of the tender offers if there is justifiable reason', and the regulation on public procurement (PPR) of 7.4.2006 no 402; — “§ 13-1. Cancellation of the competition and total rejection, paragraph (2) Contracting Authority can reject all of the tender offers if the result of the competition gives justifiable reason for it', FFI chooses to cancel the competition 002-2016 HF radios for Lab and field testing in the Norwegian Armed Forces, unfortunately did not appear in the tender documentation specifications. FFI chooses to cancel the competition as in the period after the tender deadline it became apparent to FFI that an important and specific requirement for future HF radios in the Norwegian Armed Forces, unfortunately did not appear in the tender documentation specifications. The specific requirement is briefly mentioned in the introduction of the tender documentation point 4 Requirement Specification and Award Criteria, but does not give explicit requirements for the tenderers in this area. As a result, the tender offers received in the competition are not optimized (technical and economic) for future HF radios in the Norwegian Armed Forces. It is important for FFI to be able to test the future concept for HF communication and to be able to procure equipment that is in line with this architecture, the specifications that have arisen after the tender deadline must be included in the procurement. FFI believes that there are justifiable grounds to cancel the competition in line with § 13-1 as in retrospect needs have become apparent that change the conditions of the competition. At a later point in time a new competition will be announced where the specifications are better suited to the need of the Norwegian Armed Forces, and FFI's need for interoperability with the existing equipment. A new announcement will give all the tenderers the possibility to compete on the same basis. FFI will invite all the tenderers who have offered their products in this competition, to participate in any new competition.
