Fixed-wing aircraft. The Secretary of State for Defence (the Authority) through the Hercules Tristar Project Team proposes to award a contract to Lockheed Martin Aeronautics Company (“the Contractor”) for the design, development and trial kit installation of a Radio Frequency Defensive Aids System modification to the Hercules C130J aircraft using Government Furnished Equipment from the C130K aircraft. This Voluntary Ex Ante Transparency Notice (VTN) links to the previous VTN reference 2013/S 124-213611 of 25.6.2013 and Contract Award Notice reference 2013/S 156-272860 of 9.8.2013 whereby a Contract was entered into for long lead time activity in support of this requirement. It is considered that this contract can be placed using the Negotiated Procedure without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011). This is for reasons connected to exclusive rights in the form of copyright, confidential information and other exclusive rights in the design, drawings, software and other technical data relating to the Hercules C130J which reside exclusively with the Contractor. The proposed contract services cannot be provided without access to that proprietary information and data.
