Bridgend County Borough Council (the "Council") proposes to enter into an agreement with Coastal Housing Association ("Coastal), which is another contracting authority, under which Coastal will (using a contractor procured via a framework in accordance with Directive 2004/18/EC) demolish the existing multi-story car park, construct a new car park, and also construct social housing on the remainder of the site. The Council owns the land and will on completion of the works grant a 125-year lease of the housing element to Coastal. This collaboration is designed to fulfil the public functions of the Council (regeneration) and Coastal (social housing provision and regeneration) and is governed solely by considerations relating to the pursuit of objectives in the public interest. Also, no private undertaking is placed in an advantageous position vis-a-vis its competitors. Coastal is not a private undertaking, but a registered social landlord. Even if it were, the scheme is only viable if part-funded by social housing grant and only a registered social landlord which is approved ("zoned") for this area can access social housing grant, therefore no private undertaking would be eligible. Therefore, the arrangement between the Council and Coastal falls within the public sector collaboration exception established by the European Court of Justice in Commission of the European Communities -v- Federal Republic of Germany (Case 480/06) [2009] ECR I-4747 (the "Hamburg" case). Therefore the arrangement between the Council and Coastal is not subject to the requirement to tender it in accordance with Directive 2004/18/EC. The contract between Coastal and its construction contractor will be placed via a framework in accordance with the provisions of Directive 2004/18/EC.
