Provision of Judicial Pay, Pensions and Pay Claim Administration

This Prior Information Notice is to alert the market that the Ministry of Justice is considering the placement of Contracts for the following services: Lot 1: Administration of Judicial Pension schemes Lot 2: Administration of Judicial pay claim compensation payments Lot 3: Administration of Judicial Pension and salary payroll Interested parties will be able to bid for all or any of the above lots. Below is a summary of the Department's requirements. Lot 1: Administration of Judicial Pension schemes There are three pension schemes in this lot. A. Judicial Pensions schemes There are several separate Judicial Pension schemes that provide benefits for the majority of the salaried Judiciary within the United Kingdom. Most of the Judiciary are, however, members of the one remaining open scheme which was established by the Judicial Pensions and Retirement Act 1993. All of the schemes are defined benefit, final salary, contracted-out pension schemes for the purposes of the Pension Schemes Act 1993. The schemes are also, for the purpose of tax, non-registered schemes. The schemes provide contingent dependant's benefits as well as ill health and death benefits. Aside from the main scheme benefits there are also provisions for Additional Voluntary Contributions (AVCs), these AVC provisions are, however, registered schemes for the purposes of tax. B. Fee-paid Judicial pension scheme The Department is also responsible for 8,200 fee-paid Judiciary, a number of whom are currently involved in litigation against the Department for the right to receive pension benefits in respect of their Judicial fee - paid service. Following the Supreme Court judgment in February 2013 in the case of O'Brien v Ministry of Justice (O'Brien litigation) the Department may be required to create a pension scheme that is analogous to the relevant existing Judicial Pension schemes. However, the litigation is ongoing with the Employment Tribunal's rulings expected during the early part of 2014. C. 2015 Judicial Pension scheme As part of the implementation of the Public Service Pensions Act 2013, the Department will have to administer a new pension scheme for the judiciary. The scheme will come into existence from 1 April 2015 and will mirror in most aspects the provisions of the new civil service scheme. It will be a career average scheme with no automatic lump sum and will be registered for the purposes of the Finance Act 2004. All new appointees from 1 April 2015 (salaried and possibly fee-paid(subject to the above-mentioned litigation) will join this scheme as will some members of the current scheme who do not have a right under the 2013 Act to remain in their current scheme. Membership The current membership profile is as follows (estimated for 2015 and fee-paid scheme): Judicial Pension Scheme; Active Members: 2240 Preserved Members: 10 Pensioners: 1902 Fee paid Judicial Pension scheme (subject to litigation) ; Active Members: c 4 000 to 8 000 Preserved Members: Unknown Pensioners: Unknown 2015 Judicial Pension Scheme; Active members: c 590 salaried and c 2 000 to 4 000 fee paid (subject to liitigation) Preserved members: Unknown Pensioners: Unknown Lot 2: Administration of pay claim compensation payments The second element of the O'Brien litigation is in respect of the Terms and Conditions of the fee-paid judiciary. Dependant upon the outcome of the Employment Tribunal litigation (and any appeals), there may be a requirement to remunerate the claimants with any deemed shortfall in respect of payments for leave, fees and other elements of pay. This would be a one -off payroll compensation exercise with substantially shorter contract duration in comparison to the pensions administration contract. The potential number of compensation payments may be between 4 000 and 8 000. Lot 3: Administration of pension payroll The Department is considering the future administration of the Judicial pension payroll. Currently the payroll and pensioner payroll function is provided in the following format: a)The majority of the salaried and fee-paid Judiciary receive their payments through the Department's payroll provider. This element of the payroll services is not under review. b)The rest of the salaried Judiciary, such as High Court Judges receive their salary payments through an external supplier who is also responsible for the pension payroll function for all of the Judiciary. It is this function that is under review for future services.
