Technical Adviser Support for the Rail Franchising Programme

Since 1995, the operation of passenger rail services in the United Kingdom has been franchised to various private sector train operators. Private sector companies win this right, through an OJEU selection process, for several years at a time. The Department for Transport is the franchising authority for most of the UK rail industry. Procuring a rail franchise is a complex operation, requiring many decisions that need to be taken on the basis of the evidence provided in the applicants' responses to the tender. The Technical Advisers, appointed by the Department for each franchise, provide an important service in identifying and quantifying the service and its benefits for each franchise. Government policy on franchising is still evolving, and the cancellation of the Intercity West Coast franchising process on 3.10.2012, has meant that the existing competitions have been paused, pending the outcome of two reviews. These reviews, led by Sam Laidlaw (which was published on 6 December) and Richard Brown (which will report at the end of December) are, or will be, available from https://www.gov.uk/government/publications Any future ITT will depend on the findings of the Brown Review and, in particular, his conclusions in relation to currently paused franchise procurements. Therefore, the forthcoming ITT will necessarily be of a very open nature. In anticipation of the completion of both reviews, the Department wishes to secure a framework for the relevant technical advisory resources to support a range of franchise options over the next 5 years - the precise number, order and duration of which are currently unknown. The Technical Advisers will be required to agree to the Department's standard terms and conditions and work as part of a team, including internal and external stakeholders along with other consultants providing financial and legal services, to assist the Department with one, or more, franchises. The overall aim is to support and assure the Department in delivering effective, value for money franchises in an efficient and robust manner, notwithstanding that the order, timing, type of contract or length of franchise may all be subject to change. The Department will award the Technical Adviser contracts on the basis of the most economically advantageous tender - taking into consideration value for money and the adviser's capacity to fulfill the assignment(s). The Department reserves the right to amend the scope of the franchises or the order in which they are let at any time; and additionally reserves the right to award some, all or none of the Technical Adviser contracts mentioned in this document. It is anticipated that the OJEU notice will be issued on or after 11.1.2013.
