Doncaster Metropolitan Borough Council (the ‘Council’) currently owns and operates 7 residential care homes for older people (each a ‘Home’ together the ‘Homes’). Following a decision taken earlier in the year and a market review by council officers, the Council is looking at opportunities, through an open and transparent process, to transfer the Homes, to a third party provider (or a series of providers) to continue to operate them as care homes. It is intended that the homes will be transferred on the basis of a long lease and the contractual arrangements with the successful providers are likely to include (amongst other things) obligations in relation to those residents who are in occupation at the point of transfer. The Council believes that the transfer of the Homes will be covered by the obligations contained in the Transfer of Undertakings Protection of Employment Regulations 2006 (as amended) and any existing staff in any Home transferred, will transfer to the incoming provider(s). At this stage this voluntary notice is for preliminary information only and the Council will not be holding any information events or 1 to 1 sessions. The process to identify potential transferees of the Homes will begin in mid-December 2014 and further information will be made available at that stage.
