Country: Ukraine Sector: Municipal Lighting Invitation/contract reference (as per procurement plan): UMIP-QCBS-4-DNI-020 Funding sources: European Investment Bank (EIB) and the Promoter Contract type: Services Notice type: Invitation for expression of interest Issue date: 18.12.2019 Contracting authority (promoter): Public Utility Company ‘Misksvitlo’ of Dnipro City Council Closing date: 31.1.2020 Budget: 558 000 EURO without value added tax (VAT) Ukraine (hereinafter called the ‘Borrower’) received financing from the European Investment Bank (hereinafter called ‘Bank’ or EIB) in the form of a loan provided under the Finance Contract FI No 81.425 between Ukraine and EIB. The loan was provided within the framework agreement between Ukraine and EIB dated 14.6.2015, toward the cost of the Ukraine Municipal Infrastructure Programme (hereinafter called the ‘Project’ or UMIP). UMIP is a multi-sector investment programme with the borrower, Ukraine, acting through the Ministry of Finance (hereinafter abbreviated to MoF) in conjunction with the Ministry of Communities and Territories Development of Ukraine (hereinafter abbreviated to MCTDU). Under UMIP, MoF extends subloans to final beneficiaries of the Project for the purpose of financing selected municipal infrastructure projects. The project will be jointly financed by the EIB and the final beneficiaries. Public Utility Company ‘Misksvitlo’ of Dnipro City Council (hereinafter called the ‘Contracting Authority’) received a portion of the UMIP financing toward the cost of subproject ‘Rehabilitation of Public Lighting in the City of Dnipro’ to be implemented within the municipal lighting sector and intends to apply a portion of the proceeds of this financing to eligible payments under the contract for which this invitation for expressions of interest is issued. The Contracting Authority intends to establish a shortlist of qualified and competent consulting firms in relation to the following consulting services (hereinafter called the ‘Services’): provision of professional construction supervision services for the rehabilitation of public lighting in the City of Dnipro. The Services are expected to commence in June 2020 with an estimated duration of forty-one (41) months for the construction period and twelve (12) months for the defects liability period. Subject to availability of funding, the performance of the selected consultant and the specific needs of the Contracting Authority the Services may be extended beyond the current scope. The Contracting Authority now invites eligible consulting firms (hereinafter called ‘Applicants’) to indicate their interest in providing the Services. Interested Applicants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. Applications are accepted only by using an Application form available on request from the Contracting Authority. Procurement of the Services will be conducted through the procedures as specified in the guide for procurement for projects financed by EIB (EIB’s GtP), September 2018 revision (available online at https://www.eib.org/en/publications/guide-to-procurement). Shortlisted Applicants shall subsequently be invited to submit technical and financial proposals that shall be evaluated on the basis of the most economically advantageous proposal approach (consideration of quality and price) as further specified in the request for proposals. There are no eligibility restrictions based on the consultant's country of origin. Attention of interested consultants is drawn to paragraph 1.2 and 1.5 of EIB’s GtP setting forth the EIB’s policy on the eligibility of consultants, particularly in respect to the EU’s sanctioning policy and conflict of interest. The consultants shall particularly consider that a firm engaged by the Contracting Authority to provide the Services under the contract for which this invitation is issued, or any of its affiliates, shall not be eligible to provide goods, works and non-consulting services under the contract for the Rehabilitation of Public Lighting in the City of Dnipro. Consulting firms may associate with other firms in the form of a joint venture, consortium or association (JVCA) or sub-consultancy to enhance their qualifications. A type of association shall be clearly stated in the expression of interest. The experience and financial record of any proposed subcontractor shall not be included in the evaluation. No more than 1 application can be submitted by 1 consultant whatever the form of participation be (as an individual legal entity or as leader or member of a JVCA submitting an application). In the event that a firm submits more than 1 application, all applications in which that firm has participated will be excluded. The shortlisting (pre-qualification) criteria are as follows (In case of applications submitted by a JVCA, these selection criteria will be applied to the overall JVCA as a whole): 1) Core business and years in business: (a) at least fifteen (15) years of experience in rendering engineering and consulting supervision services; (b) at least ten (10) years of experience in municipal infrastructure projects, including at least five (5) years in the public lighting sector. 2) Experience in undertaking assignments of similar nature and comparable complexity: (a) at least two (2) assignments with a value at least 150 000 EUR equivalent each with activities related to construction supervision successfully and substantially (at least 80 %) completed either a) alone, b) as leader of a JVCA, or c) as a member of a JVCA with a minimum participation of 50 % of the assignment(s) brought as reference, between 1.1.2014 and the deadline for submission of EoIs; (b) at least two (2) assignments compliant with the subcriterion 2a above, implemented under contracts financed by International Financial Institutions (EIB, EBRD, World Bank, etc.); (c) at least two (2) assignments compliant with the subcriterion 2a implemented in Ukraine or Eastern Partnership (EaP) states or countries of the Commonwealth of Independent States (CIS) (Armenia, Azerbaijan, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Russia, Tajikistan, Uzbekistan). 3) Professional and financial strength (in case of candidate being a public body, equivalent information should be provided): (a) organizational structure: the number of permanent staff of the consultant (individual company or JVCA overall) currently working in fields related to this contract, must be at least ten (10) for each of the last 3 years (2016, 2017, 2018); (b) summary of financial information over FY 2016-2018 confirming the average annual turnover of the consultant at least 500 000 EUR equivalent for each of the last 3 years for which accounts have been closed (2016, 2017, 2018). Based on the EoIs received, between five (5) and eight (8) consultants will be shortlisted and subsequently invited to submit technical and financial proposals. If the number of eligible candidates meeting the selection criteria is less than the minimum of five (5), the Contracting Authority may invite the candidates who satisfy the criteria to submit a tender. In the event that more than eight (8) Applicants fulfil all the qualifying criteria above, the employer shall use the following 2 criteria to rank the applicants, select the top 8 of them and subsequently invite shortlisted applicants to submit technical and financial proposals: 1) the number of assignments brought as references which comply with the requirements of criterion 2a; and 2) the number of assignments brought as references which comply with the requirements of criterion 2c. In the event that only 1 Applicant is pre-qualified, it would be considered by the Contracting Authority as a lack of competition, which would, upon consultation with the EIB, subsequently result in revision of the procurement arrangements (e.g. revision of tender procedure, contract terms or qualification conditions). Expressions of interest, as well as all subsequent correspondence, shall be written in English language. Applicants are encouraged to submit a copy of the EoI in Russian or Ukrainian Language but failure to do so will not result in disqualifications of the Applicant. In case of discrepancies between the version, the English version shall prevail. The total volume of the application shall not exceed fifty (50) pages. One original and 1 copy of completed and duly signed EoI in English language should be submitted by mail or by hand to reach the Contracting Authority at the below address no later than the above indicated closing date. Applicants are encouraged to submit translation of their applications in either Ukrainian or Russian language. Additionally, applicants have the option of submitting their complete and duly signed applications in Portable Document Format (PDF) by electronic mail to the Contracting Authority’s email addresses with the following indication in the subject line: ‘UMIP-QCBS-4-DNI-020: Expression of interest for supervision services for the rehabilitation of public lighting in the City of Dnipro’.
