Dublin City Council gives notice to invoke Article 32.2 (b) for a derogation from tendering where the works, supplies or services can be provided only by a particular economic operator. Dublin City Council intend to award a contract to Softco Unlimited for 3 years at a value of €200,000 excl. VAT. Dublin City Council uses the Softco document management system. This system is integrated with a number of Dublin City Council applications. Licences must be renewed annually and the system must be maintained, upgraded and the associated hardware managed. As Softco technology is the sole intellectual property of Softco Unlimited Dublin City Council can only obtain these licences and support services from Softco Unlimited.
